2026 TERMS & CONDITIONS OF CHARITY PARTICIPATION

 

UPON REVIEW AND APPROVAL OF THIS SUBMISSION BY PGA TOUR Charities, Inc., a 501(c)(3) charitable corporation organized under the laws of the State of Florida (“PGA TOUR Charities”), this Agreement shall govern participation by the charity identified above, a 501(c)(3) corporation organized under the laws of the State indicated above with the Federal Taxpayer Identification Number (EIN) also indicated above (“Charity”) in the program described below.

Biltmore Championship Asheville is a PGA TOUR professional golf tournament held at The Cliffs at Walnut Cove in North Carolina. The tournament is operated by PGA TOUR Enterprises, LLC and is focused on generating revenue for charitable organizations in the Asheville Metropolitan Area including Buncombe, Haywood, Henderson and Madison Counties.

Consent to Receive Program Communications

By registering for the Birdies for Charity (B4C) program, your organization agrees to receive communications from the tournament team related to your participation. These communications are essential to the administration and success of the program and include, but are not limited to:

           Weekly updates on fundraising totals

           Program announcements and updates

           Important deadlines and logistical information

Participation in Birdies for Charity requires acceptance of these communications. By completing registration, your organization acknowledges and agrees to this requirement.

Birdies for Charity is a fundraising program designed to give participating charities the opportunity to generate contributions for their organization in connection with the Biltmore Championship Asheville.

The primary goal of the Birdies for Charity program is to successfully solicit and collect donations from the general public. PGA TOUR Charities is dedicated to advancing charitable giving, raising awareness of area charities and grantmaking to charities which PGA TOUR Charities approves. PGA TOUR Charities will manage the operation of the Birdies for Charity program for Biltmore Championship Asheville but will not solicit donations for or on behalf of any participating charity. 100% of the donations collected will go to the particular approved charity who solicited the donation. In the event PGA TOUR Charities cannot distribute amounts donated under the Birdies for Charity program to a participating charity, PGA TOUR Charities will use the amounts for other charitable purposes.

Participating charities are prohibited from soliciting donations in advance of the official kick-off of the program. Charities may notify constituents via normal communication (e.g., newsletter) that the charity is participating in the program but may not directly or indirectly request a donation be made in advance of the official program period. Failure to abide by this prohibition will result in expulsion from the program.

Limited Use of the Birdies for Charity and Biltmore Championship Asheville™ names and marks (together, the “Charity Marks”) will be granted to participating charities provided that samples of any material created outside of the PGA TOUR Charities-provided marketing toolkit (available for download at (https://www.biltmorechampionship.com/community) (the “Marketing Toolkit”), which bear such Charity Marks must be submitted to the tournament office for approval prior to distribution. “Limited Use” means the public use of certain Charity Marks associated with material related to the digital marketing and promotion of the Birdies for Charity program outside of what has been provided within the Marketing Toolkit. Usage of material found within the Marketing Toolkit does not require prior approval of the tournament office. Unauthorized use of the Charity Marks or any trademark owned or licensed by PGA TOUR Enterprises, LLC or is strictly prohibited and is grounds for immediate expulsion from the program

Donations to participating charities in the program will be equal to 100% of the collected donations. No payment will be made for uncollected donations.

Payments of donations via credit card may be made online through the PGA TOUR Charities website link provided. All other forms of payment may be made to the participating charity directly.

No cash donations will be accepted. Government grants, foundation grants, membership dues and existing pre-arranged donations are NOT eligible Birdies for Charity donations. PGA TOUR Charities will make one grant to each participating charity of donations collected by PGA TOUR Charities under the Birdies for Charity program based on a distribution schedule determined by PGA TOUR Charities in its sole discretion. PGA TOUR Charities will make final grants to each participating charity of any previously ungranted donations collected by PGA TOUR Charities under the Birdies for Charity program on or about on or about December 16, 2026.

Finally, additional financial support from PGA TOUR Enterprises, LLC in conjunction with Biltmore Championship Asheville may be provided on or about December 16, 2026, local charitable organizations are eligible to receive a portion of bonus pool funds (maximum bonus of $10,000 per charity; $50,000 for the entire program).

Each participating charity must be and must remain throughout the Birdies for Charity program a United States 501(c)(3) charitable entity, duly formed, validly existing and in good standing under the laws of its state of formation and must remain qualified to do business, including this charitable solicitation activity, in all jurisdictions in which the nature of its business or assets would so require. Each participating charity, including the individual registering for participation on behalf of the charity, represents that it has full power and authority to enter into and perform its obligations under the program and that the consummation of the transactions contemplated by participation have been duly and validly authorized. The Charity signing below represents and warrants it has registered to conduct charitable solicitations in the state of North Carolina, or is otherwise exempt and has complied with state law, including The North Carolina Solicitation Act. These terms and conditions constitute a legal, valid and binding agreement of charity and are enforceable against it in accordance with its terms. Each charity agrees that it and any employees, agents or contractors it may employ or utilize shall comply with all applicable laws, statutes, ordinances, rules and regulations of any governmental authority and with any rules or regulations promulgated by PGA TOUR Birdies for Charity in connection with the program.

Further, each charity covenants and agrees to indemnify and hold PGA TOUR, Inc., PGA TOUR Enterprises, LLC and PGA TOUR Charities and their respective officers, directors, employees, affiliated entities, and sponsors (and their respective officers, directors and employees) (collectively, the “TOUR Indemnitees”) harmless from and against any and all losses, claims, damages, expenses, judgments, awards, petitions, demands or liabilities (including without limitation reasonable counsel fees whether incurred in preparation for trial, at trial, on appeal or in bankruptcy proceedings), joint or several, to which any of TOUR Indemnitees may become subject (collectively, “Claims”) arising out of or in connection with (a) charity’s breach of its obligations, (b) the negligence or willful misconduct by charity or its officers, directors, employees, contractors or agents in connection with the performance of charity’s obligations except to the extent that any such Claim arises from the negligence or willful misconduct of a TOUR Indemnitee, and/or (c) any aspect of the development, implementation, promotion, and operation of a sweepstakes, raffle or contest conducted by charity related to the Birdies for Charity program, including without limitation, any claim asserted by any governmental or regulatory entity related thereto. The TOUR Indemnitee will notify charity promptly upon receipt of notice of any such Claim, and charity will assume responsibility for the defense thereof on behalf of the appropriate TOUR Indemnitee at charity’s sole cost and expense. This indemnity shall survive termination or expiration of the program.

The rules for approval, participation and grantmaking may be amended at any time by PGA TOUR Charities. PGA TOUR Charities is a 501(c)(3) charitable Florida organization.

OFFICIAL RULES

No purchase or donation is required to participate in the Birdies for Charity Contest or to become eligible to receive a prize. A purchase or donation will not increase a participant’s likelihood of winning a prize. All methods of entry have an equal chance of winning. Void where prohibited by law. This Contest (as defined below) is subject to all applicable federal, state, and local laws and regulations. Odds of winning depend on the number and timing of eligible entries received, regardless of method of entry.

  • ELIGIBILITY. The Birdies for Charity Contest (“Contest”) is open to all individuals who are legal residents of the fifty (50) United States (excluding New York), eighteen (18) years of age or older. Employees of PGA TOUR Enterprises, LLC (“TOUR”), Biltmore Estate, its affiliates, and paid tournament staff, employees of, and the immediate family members of each and those residing in the same household are not eligible. A participant need not be present to win. Participation acts as each entrant’s authorization and subscription to be included in TOUR communications, including email, regarding information, updates and offers of PGA TOUR Enterprises, LLC (“Sponsor”) its sponsors and affiliates, subject to exercise by an entrant of a provided option to opt out of such inclusion. Eligibility to participate is not dependent upon inclusion in such communications.
  • HOW TO ENTER. The Contest will commence at 9:00 AM ET on June 24, 2026, and will end at 6:00 PM ET on September 16, 2026 (the “Contest Period”). An entrant must submit a guess of the total number of birdies made during the competitive rounds of the 2026 Biltmore Championship Asheville (the “Tournament”). To make a submission, an entrant may elect to participate by: (1) submitting a completed entry form at https://p2p.onecause.com/biltmorebfc with a minimum donation of at least $20.00 (donations accepted via credit card only); (2) mailing a completed manual donation form available at biltmorechampionship.com/birdies along with a minimum donation of at least $20.00 to the charity specified therein (donations accepted via physical check only); or, to enter without making a donation, (3) mailing a paper document with (a) entrant’s guess of the total number of birdies made during the Tournament; (b) the answer to one (1) “tie breaker” question: (i)“I guess that exactly [insert number] of eagles will be made on the 17th hole during competition rounds” (“Tie Breaker No. 1”); and (c) and entrant’s full legal name, full address, email address and telephone number, in an envelope to: PGA TOUR Charities, Inc., Attn: Birdies for Charities Community Impact Team  – Biltmore Championship Asheville, 1 PGA TOUR Blvd, 2nd Floor, Ponte Vedra Beach, FL 32082. Clear, legible handwriting is the responsibility of all participants. Sponsor is not responsible for any errors caused by poor penmanship. Entries received without a donation will be treated the same as donation entries and have an equal chance of winning. Each separate entry received will constitute one (1) entry. Entrants are limited to no more than ten (10) total guesses per household, regardless of whether such guesses are received through online entry form, manual donation, or paper document submission). Each guess must be on a separate official entry form. If more than ten (10) guesses are received from any one household, only the first ten (10) guesses received and recorded will be eligible for the prize. All entries must be received by 6:00 PM ET on September 16, 2026, to be eligible. Entry via automated means (e.g., through a computer program, bots, etc.) is prohibited and will result in disqualification. Any attempt by an entrant to obtain more than the approved number of entries (10) by using multiple/different email addresses, identities, registrations, logins, etc. will void such entries and that entrant may be disqualified. Normal Internet usage charges, if any, imposed by entrant’s online service company will apply. All entries become property of Sponsor and will not be acknowledged or returned.

The exact number of birdies made during the Tournament will include all birdies made by PGA TOUR players on Thursday through Sunday (September 17 – September 20) and any birdies made during the Tournament playoff rounds, if applicable. The total so determined shall be the “Total Number of Birdies” made during the Tournament for all purposes, specifically including this Contest and the awarding of the prize.

Should TOUR or Tournament officials cancel one or more rounds of competitive play due to weather or other conditions, then the following number of birdies shall be added to the Tournament’s birdies total to determine the total number of birdies made during the Tournament solely for purposes of the Birdies for Charity Contest and the awarding of the Prize:

TOUR officials will determine the final number of birdies made except as provided for herein.

PRIZE & ESTIMATED RETAIL VALUE. Only one (1) grand prize will be awarded. The prize is The Ultimate Biltmore Experience which shall include a three (3) night stay for two (2) guests in a Chateau Tier suite at the Forbes 4 Star Inn on the Property, Chef’s breakfast for two (2) daily in The Dining Room, one (1) Dinner for two (2) in The Dining Room, Expert Guided Tour of Biltmore House for two (2), Red, Wine & Chocolate experience for two (2) and Valet Parking. The prize has a total approximate retail value (“ARV”) of US $5,000.

WINNER IDENTIFICATION. Winner identification will be conducted on or about October 16, 2026 from among all eligible entries received by a representative of Sponsor in Ponte Vedra Beach, Florida, whose decision is final. At the conclusion of the Contest Period, the entrant whose guess identifies the exact number (or closest thereto without going over) of birdies made during the competitive rounds of the Tournament will be deemed the potential grand prize winner. The entrant whose guess is the next closest to the actual result without going over (after the grand prize winner has been determined) will be deemed the potential second prize winner.

In the event two (2) or more entrants submit identical, eligible guesses, the tie will be resolved by reference to Tie Breaker No. 1. The entrant who answers Tie Breaker No. 1 most accurately will be deemed the winner. Sponsor reserves the right to award the prize in its sole discretion, including by random drawing among the tied entrants.

Eligibility of the potential winner is subject to verification of eligibility by Sponsor and compliance with these Official Rules. Winner is responsible for all taxes associated with award of the grand prize, including, but not limited to, local, state, and federal taxes.

  • LIMITATION OF LIABILITY. Sponsor Entities are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized for the Contest or by any human error which may occur in the processing of the entries in the Contest or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the application/website(s) or  Contest. Sponsor and its agencies are not responsible for incomplete, illegible, misdirected, damaged, lost or late entries or for any human error which may occur in the processing of the entries in this Contest. In the event of a dispute as to any entry, the authorized account holder of the account used to register will be deemed to be the entrant. Winner may be required to show proof of being the authorized account holder of the account associated with the entry. Proof of entering information via the application/websites does not constitute proof of delivery or receipt of such information. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Contest is not capable of running as planned, including sabotage, acts of God, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the integrity, administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at its sole discretion to cancel the Contest and determine the applicable winner from among all eligible entries received prior to cancellation In the event of cancellation, the prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation.  Notice of cancellation will be posted at https://www.biltmorechampionship.com/.

SPONSOR MAKES NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS CONTEST OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING PRIZE. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

  • GOVERNING LAW. This Contest is subject to all applicable federal, state, provincial, territorial, municipal and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Florida. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in St. Johns County, Florida. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages.
  • WINNER LIST. For the name of the winner, send a self-addressed stamped envelope, within six (6) months of the drawing date, to: Birdies for Charity – 2026 Biltmore Championship Asheville Winner List: 1 PGA TOUR Blvd, Ponte Vedra Beach, FL, 32082.
  • SPONSOR. The Sponsor of the Contest is PGA TOUR Enterprises, LLC.
